Alexander McLachlan was found guilty of the following offences: 

1.    2 counts of Assault, contrary to section 266 of the Criminal Code of Canada. 

2.    Overcome Resistance by Attempting to Choke, contrary to section 246(a) of the Criminal Code of Canada. 

Date: June 24, 2025 

SENTENCE: September 25, 2025 

• Conditional Sentence Order permitting the sentence of 15 months imprisonment (concurrent for each offence) to be served in the community if the sentence conditions below are obeyed. 

•  Probation Order for period of 18 months following the Conditional Sentence.   (See below for Probation Conditions) 

•  Victim surcharge of $600  

•  Weapons Prohibition for a period of 10 years (s. 109 Criminal Code) 

•  DNA Order 

CONDITIONAL SENTENCE CONDITIONS 

1.    Keep the peace and be of good behaviour. 

2.    Appear before the court when required to do so by the court. 

3.    Report as the Court directs in person to a supervisor and thereafter report when required by  the supervisor and in a manner directed by the supervisor. 

4.    Remain in Ontario unless you have prior written permission from the Court or the supervisor to leave the province. 

5.    Notify the court or supervisor in advance of any change of name or address and promptly notify the court or supervisor of any change in employment or occupation. 

6.    Report to a supervisor immediately and after that, at all times and places as directed by the supervisor or any person authorized by a supervisor to assist in his supervision. 

7.    Live at a place approved of by the supervisor and not change that address without obtaining the consent of the supervisor in advance. 

8.    This home confinement condition will be in effect for the first 10 months of the sentence. 

9.    Remain in your residence or on the property of your residence at all times except: 

between 1pm and 6pm on Saturdays in order to acquire the necessities of life; for any medical emergencies involving you or any member of your immediate family (spouse, child, parent, sibling); for going directly to and from or being at religious services and legal or medical or dental appointments; for going directly to or from and being at assessment, treatment or counselling sessions; with the prior written approval of the supervisor.  The written approval is to be carried with you during these times; for going directly to and from or being at employment or schooling, with the schedule provided in advance to your supervisor. 

10.    Following your home confinement (see above), for the balance of your Order, remain in your residence or on the property of your residence at all times daily between the hours of 10:00 p.m. and 06:00 a.m. except: 

for any medical emergency involving you or any member of your immediate family (spouse, child, parent, sibling); with the prior written permission of your supervisor.  The written approval is to be carried with you during these times; for going directly to and from or being at employment or schooling, with the schedule provided in advance to your supervisor; for going directly to or from and being at assessment, treatment or counselling sessions; for going directly to and from or being at religious services and legal or medical or dental appointments.  

11.    Do not contact or communicate in any way, either directly or indirectly, by any physical, electronic or other means with named persons except for specified conditions. 

12.    Do not be within 100 metres of any place where you know named persons to live, work, go to school, frequent or any place you know them to be except for required court attendances with specified exceptions. 

13.    Attend and actively participate in all assessment, counselling or rehabilitative programs as directed by the supervisor and complete them to the satisfaction of the supervisor. 

14.    You shall sign any release of information forms as will enable your supervisor to monitor your attendance and completion of any assessments, counselling or rehabilitative programs as directed. 

PROBATION CONDITIONS:

3.    Notify the court or the probation officer in advance of any change of name or address and promptly notify the court or the probation officer of any change in employment or occupation. 

4.    Report to a probation officer as directed by your conditional sentence supervisor upon the expiry of your conditional sentence order and after that, at all times and places as directed by the probation officer or any person authorized by a probation officer to assist in your supervision. 

5.    Live at a place approved of by the probation officer and not change that address without obtaining the consent of the probation officer in advance. 

6.    Do not contact or communicate in any way, either directly or indirectly, by any physical, electronic or other means, with named persons with specified exceptions. 

7.    Do not be within 100 metres of any place where you know named persons to live, work, go to school, frequent or any place you know named persons to be except for required court attendances, with specified exceptions. 

8.    Attend and actively participate in all assessment, counselling or rehabilitative programs as directed by the probation officer and complete them to the satisfaction of the probation officer.

APPEALED:  Dr. McLachlan has appealed the decision.
