In its reasons for decision released May 2, 2025, the Tribunal found that Dr. Kilian, in her non-compliance with the College’s investigation, engaged in professional misconduct by failing to respond appropriately or within a reasonable time period to a written inquiry by the College and failing to cooperate with the College’s investigation. The Tribunal further found that Dr. Kilian’s conduct was disgraceful, dishonourable or unprofessional.

A penalty hearing was held on August 15, 2025, after which the Tribunal reserved its decision on penalty.  

The panel’s reasons for decision on penalty were released on October 22, 2025. The Tribunal ordered that: 

  1. the registrant attend before the panel to be reprimanded;
  2. the Registrar suspend the registrant’s certificate of registration for 12 months commencing at 12:01 a.m. on October 23, 2025;
  3. the Registrar to place the following terms, conditions and limitations on the registrant’s certificate of registration:
    1. the registrant shall participate in and successfully complete, without condition or qualification and at her own expense, the PROBE Ethics & Boundaries program offered by the Centre for Personalized Education for Professionals. Completion must include a passing evaluation or grade, without condition or qualification, within six months of the date of this order. Proof of successful completion —including registration, attendance, and participant assessment reports — must be provided to the College within one month of program completion;
    2. the registrant receive individualized instruction on ethics and professionalism with an instructor acceptable to the College. The instructor will receive background information from the College, review the relevant issues with the registrant, and assist her in understanding the nature and seriousness of the concerns, as well as strategies to avoid similar conduct in the future. Upon completion, the instructor will submit a report to the College;
    3. before resuming practice, the registrant must satisfy the requirements of the College’s policy on Ensuring Competence: Changing Scope of Practice and/or Re-Entering Practice.
  4. the registrant pay the College costs in the amount of $36,295 by November 21, 2025.
