Past Tribunal Proceedings (1)

Proceeding Type: Discipline referral to OPSDT
Date of Decision: 06 May 2025
Summary of Decision:
On May 6, 2025, the Tribunal found that Dr. Sidhu committed professional misconduct, under subsection 1(4) of O. Reg. 856/93. This provision applies where: an allegation of professional misconduct was made against the registrant in another jurisdiction, the registrant has entered into an agreement or compromise to settle the matter without a finding of misconduct or incompetence or a similar finding being made; and the act or omission that is the subject of the allegation would, in the opinion of the College, be an act of professional misconduct in Ontario.

The Tribunal’s finding was based on records from the Medical Board of California, which had filed an Accusation alleging that Dr. Sidhu engaged in sexual misconduct with a patient while practising in that jurisdiction. To resolve the pending discipline proceedings, Dr. Sidhu voluntarily entered into a Stipulated Surrender of License and Order, surrendering his certificate to practice in California.

Order
The Tribunal ordered that:
  • Dr. Sidhu attend before the panel to be reprimanded;
  • the Registrar suspend Dr. Sidhu’s certificate of registration for 10 months commencing May 7, 2025 at 12:01 a.m; and
  • the Registrar place the following terms, conditions and limitations on the registrant’s certificate of registration effective May 7, 2025 at 12:01 a.m.:
  1. Dr. Sidhu shall participate in and successfully complete, without condition or qualification and at his own expense, the PROBE Ethics & Boundaries program offered by the Centre for Personalized Education for Professionals. Dr. Sidhu will complete the PROBE Program within six (6) months of the date of this Order, or if it is not available within that timeframe, at the earliest opportunity. He will provide proof of completion to the College, including proof of registration and attendance and participant assessment reports, within one (1) month of completing it; and
  2. Dr. Sidhu shall not communicate with patients outside of in-person encounters at any practice location, unless such communication complies with the College’s Virtual Care Policy.
  • Dr. Sidhu pay the College costs in the amount of $6,000 by June 4, 2025.
