In its reasons for decision released September 17, 2025, the Tribunal found that Dr. Garcia Pan sexually abused AE, a patient. The Tribunal found that Dr. Garcia Pan:
- made inappropriate and/or sexual remarks to AE;
- engaged in inappropriate and/or sexual touching of AE, including of her breasts; and buttocks; and
- engaged in inappropriate and/or sexual behaviour towards AE.
The panel further found that these acts constituted disgraceful, dishonourable or unprofessional conduct.
In accordance with section 51(4.2) of the Code, the Tribunal suspended Dr. Garcia Pan on an interim basis, given the nature of the sexual acts he was found to have engaged in with AE. The suspension took effect at 12:01 a.m. on September 18, 2025, and remains in place pending the outcome of the penalty hearing.
