On November 9, 2022, the Ontario Physicians and Surgeons Discipline Tribunal found that Dr. Khan committed the following acts of professional misconduct:
- failing to maintain the standard of practice of the profession; and
- engaging in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by registrants as disgraceful, dishonourable or unprofessional.
The Tribunal also found that the registrant is incompetent.
On January 17, 2023, the Tribunal ordered that:
- the registrant attend before the panel to be reprimanded;
- the Registrar revoke the registrant’s certificate of registration effective immediately; and
- the registrant pay the College costs in the amount of $72,590 by March 15, 2023.

On July 15, 2022, the Tribunal ordered that:
- the registrant attend before the panel to be reprimanded;
- the Registrar revoke the registrant’s certificate of registration effective immediately; and
- the registrant pay the College costs in the amount of $197,030 by October 17, 2022.

On August 10, 2022, Dr. Khan filed a Notice of Appeal with the Divisional Court appealing the Tribunal’s order dated July 15, 2022.
As set out in s. 71 of the Health Professions Procedural Code, this order remains in effect despite the appeal.

A summary of a decision of the Inquiries, Complaints and Reports Committee in which the disposition includes a "caution-in-person" is required by the College by-laws to be posted on the register, along with a note if the decision has been appealed. A “caution-in-person” disposition requires the physician to attend at the College and be verbally cautioned by a panel of the Committee. The summary will be removed from the register if the decision is overturned on appeal or review. Note that this requirement only applies to decisions arising out of a complaint dated on or after January 1, 2015, or if there was no complaint, the first appointment of investigators dated on or after January 1, 2015.
