Summary of Decision:
On April 7, 2021, the College referred allegations of professional misconduct against Dr. Hanmiah to the Discipline Committee, now the Ontario Physicians and Surgeons Discipline Tribunal.

The Notice of Hearing alleged Dr. Hanmiah had engaged in disgraceful, dishonourable or unprofessional conduct and that Dr. Hanmiah failed to maintain the standard of practice of the profession.

The OPSDT heard the matter on January 24, 2022 by videoconference. Both parties attended. The College was represented by Counsel and Dr. Hanmiah represented himself.

On the basis of a Statement of Uncontested Facts and Plea of No Contest and after hearing submissions from both parties, the OPSDT found Dr. Hanmiah committed an act of professional misconduct in that he engaged in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional and that he has failed to maintain the standard of practice of the profession.

Penalty

The OPSDT considered an Agreed Statement of Facts on Penalty which stated that on January 24, 2022, Dr. Hanmiah entered into an undertaking with the College in which he agreed to resign from the College and not to apply or re-apply for registration as a physician to practise medicine in Ontario or any other jurisdiction, effective immediately. On January 24, 2022, the OPSDT issued its Order directing that:

- Dr. Hanmiah attend before the panel to be reprimanded;
- Dr. Hanmiah pay costs of $6,000 to the College by February 24, 2022.
