The matter was appealed to the Health Professions Appeal and Review Board (“HPARB”) and HPARB affirmed the decision. An application for judicial review of HPARB’s decision has been commenced in the Divisional Court.
On May 7, 2024, the Divisional Court dismissed Dr. Gill's application. On May 22, 2024, Dr. Gill brought a motion in the Court of Appeal for Ontario seeking leave to appeal the Divisional Court decision of May 7, 2024. On October 3, 2024, the Court of Appeal dismissed Dr. Gill’s motion for leave to appeal. On November 29, 2024, Dr. Gill commenced an application for leave to appeal in the Supreme Court of Canada. On May 2, 2025, the Supreme Court of Canada dismissed Dr. Gill’s application.
Caution-in-Person:
A summary of a decision of the Inquiries, Complaints and Reports Committee in which the disposition includes a "caution-in-person" is required by the College by-laws to be posted on the register, along with a note if the decision has been appealed. A “caution-in-person” disposition requires the physician to attend at the College and be verbally cautioned by a panel of the Committee. The summary will be removed from the register if the decision is overturned on appeal or review. Note that this requirement only applies to decisions arising out of a complaint dated on or after January 1, 2015 or if there was no complaint, the first appointment of investigators dated on or after January 1, 2015.
